These Terms of Service govern your access to and use of premirabelle.com and your purchase of products from Premira Belle.
Throughout these Terms, “Premira Belle,” “we,” “us” and “our” refer to the operator of premirabelle.com. “You” and “your” refer to the customer or website visitor.
By accessing our website, submitting an order or using our services, you agree to these Terms, our Privacy Policy, Return and Refund Policy and Shipping Policy. If you do not agree, you should not use the website.
1. ELIGIBILITY AND ACCEPTABLE USE
You must be legally capable of entering into a binding agreement in your jurisdiction to make a purchase.
You may use the website only for lawful, personal and non-commercial purposes. You must not interfere with the security or operation of the website, submit false information, impersonate another person, introduce malicious code, scrape the website without authorization or use our services for an unlawful purpose.
2. PRODUCT INFORMATION
We make reasonable efforts to present product descriptions, colors, measurements, materials and images accurately. Screen settings, photography and manufacturing variations may cause minor differences.
Product availability, sizes, colors and prices can change without notice. We may correct typographical errors or inaccuracies and may update product information at any time.
Customers are responsible for reviewing the product description and available measurements before ordering.
3. ORDERS
An order confirmation acknowledges that we received your order; it does not necessarily mean that the order has been accepted or shipped.
We may reject, limit or cancel an order when reasonably necessary, including because of suspected fraud, payment failure, inventory unavailability, pricing errors, shipping restrictions or incorrect customer information.
If we cancel a paid order, we will refund the affected amount to the original payment method.
Purchases are intended for personal or household use and not for unauthorized commercial resale.
4. CANCELLATIONS AND ORDER CHANGES
Cancellation requests may be submitted within 24 hours after purchase, but cancellation is not guaranteed. An order normally cannot be cancelled or changed after processing or shipment has begun.
You are responsible for checking the product, size, color, billing information and delivery address before submitting an order.
5. PRICES, PAYMENTS AND TAXES
Prices are displayed in the currency shown on the website or at checkout. Prices and promotions may change without notice.
The price charged is the price displayed when the order is submitted, subject to correction of an obvious error.
You agree to provide current, complete and accurate billing and payment information. Taxes, shipping charges, duties or other applicable charges will be displayed at checkout when available or may be charged by the relevant authority.
6. SHIPPING AND DELIVERY
Orders may be fulfilled from different warehouses and may arrive in separate packages.
Delivery dates are estimates and are not guaranteed. Carrier delays, customs processing, severe weather, holidays, incorrect addresses and other circumstances outside our reasonable control may affect delivery.
Shipping availability, charges and estimates are governed by our Shipping Policy.
7. RETURNS AND REFUNDS
Returns, non-returnable items, damaged products and refunds are governed by our Return and Refund Policy.
Nothing in these Terms restricts a mandatory consumer right that cannot lawfully be excluded.
8. CUSTOMER ACCOUNTS
If you create an account, you are responsible for maintaining the confidentiality of your login information and for activity conducted through your account.
You must notify us promptly if you believe your account or payment information has been used without authorization.
9. INTELLECTUAL PROPERTY
The website and its text, graphics, branding, photographs, layout, design and other content are owned by or licensed to Premira Belle and are protected by applicable intellectual-property laws.
You may use the website for personal shopping purposes. You may not copy, reproduce, republish, distribute, sell, modify or commercially exploit website content without written permission from the applicable rights holder.
10. REVIEWS AND FEEDBACK
If you submit a review, photograph, suggestion or other content, you confirm that you have the right to submit it and that it is accurate, lawful and does not infringe another person’s rights.
You grant us a non-exclusive, worldwide and royalty-free right to use, display, reproduce and adapt submitted content for operating and promoting our business, subject to applicable law.
We may remove content that is unlawful, misleading, abusive, fraudulent or otherwise inappropriate.
11. THIRD-PARTY SERVICES AND LINKS
Our store is hosted by Shopify. Payment processors, fulfillment providers, delivery carriers and other service providers may assist us in operating the store and completing orders.
Links to third-party websites are provided for convenience. We do not control and are not responsible for the content, security, availability or policies of independent third-party websites.
Purchases made from Premira Belle are transactions between you and Premira Belle, not Shopify.
12. PRIVACY
Our collection and use of personal information are described in our Privacy Policy. By using the website, you acknowledge that information may be processed by Shopify and other service providers necessary to operate the store and fulfill orders.
13. DISCLAIMER
To the fullest extent permitted by law, the website and its content are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, error-free or completely secure.
Any warranty or condition that cannot legally be excluded remains fully applicable.
14. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Premira Belle will not be responsible for indirect, incidental, special or consequential loss arising from use of the website or purchase of a product.
Nothing in these Terms excludes liability that cannot legally be excluded, including liability for fraud, intentional misconduct or mandatory consumer protections.
15. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify Premira Belle against third-party claims resulting from your unlawful use of the website, your violation of these Terms or your infringement of another party’s rights.
16. SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. The unenforceable provision will be limited only to the minimum extent necessary.
17. NO WAIVER
A failure to enforce a provision of these Terms does not waive the right to enforce it later.
18. GOVERNING LAW
These Terms are governed by the applicable laws of Alberta and the federal laws of Canada, without limiting any mandatory consumer protection available to you under the laws of your place of residence.
